AI Disclosure and Consent Agreement

Effective Date: February 20, 2026

Attorneys on the Enzio.ai platform use artificial intelligence (“AI”) tools to assist in preparing your legal documents. This disclosure explains how AI is used and obtains your informed consent as required by professional responsibility rules.

CONSENT REQUIRED: AI-assisted services are integral to how the Enzio.ai platform operates. If you do not consent to AI-assisted legal services as described below, you will not be able to use the Platform.

1. HOW AI IS USED

1.1 Document Preparation

AI tools assist attorneys by:

  • Generating initial document drafts based on your intake information
  • Suggesting relevant clauses and provisions for your situation
  • Checking documents for consistency, completeness, and errors
  • Formatting documents to meet filing requirements

1.2 Matter Analysis

AI tools assist attorneys by:

  • Analyzing your intake responses to identify relevant legal issues
  • Generating a summary of your matter for attorney review
  • Generating a client profile summary for attorney review
  • Identifying potential questions or open items for attorney follow-up

1.3 Platform Communications

AI tools may assist with:

  • Summarizing complex legal concepts into plain language for educational content on the Platform
  • Generating status updates regarding your matter
  • Providing notices and other information to Attorneys

AI tools do NOT independently communicate with you on behalf of your Attorney. All substantive communications from your attorney are sent through the Platform's messaging system as described in the Terms of Service, Section 5.5.

2. WHAT AI DOES NOT DO

AI tools used on the Platform:

  • Do NOT replace attorney judgment or decision-making
  • Do NOT provide legal advice directly to you
  • Do NOT independently communicate with you on behalf of your attorney
  • Do NOT make decisions about your legal matter
  • Do NOT process your information without subsequent attorney review of all outputs
  • Do NOT retain your personally identifiable information for use with other clients (see Section 4.3 regarding anonymized data used to improve Enzio.ai's proprietary AI systems)

3. ATTORNEY OVERSIGHT

Your assigned attorney personally reviews, edits, and approves ALL work product before it is delivered to you.

Your attorney is responsible for:

  • Reviewing all AI-generated content for accuracy
  • Ensuring documents are appropriate for your specific situation
  • Making all substantive legal decisions
  • Exercising independent professional judgment
  • Complying with all professional responsibility rules

AI is a tool that enhances attorney efficiency—it does not replace the attorney's expertise, judgment, or responsibility for your matter.

4. CONFIDENTIALITY AND SECURITY

Your information is protected by multiple safeguards:

4.1 Attorney-Client Privilege

All communications with your attorney through the Platform are protected by attorney-client privilege. This Disclosure is presented to you before an Attorney has been assigned to your matter. Upon your acceptance of an Engagement Letter and the creation of an attorney-client relationship, Enzio.ai will act as your attorney's technology agent for purposes of preserving attorney-client privilege, consistent with the principles established in United States v. Kovel, 296 F.2d 918 (2d Cir. 1961).

AI processing of your information in connection with the delivery of legal services does not waive attorney-client privilege because:

  • Enzio.ai operates under the direction of your assigned Attorney once an attorney-client relationship is established.
  • Confidentiality obligations bind all platform operations, including AI processing.
  • The third-party AI service provider is contractually bound by confidentiality obligations consistent with this Disclosure.

Before Attorney assignment, information you submit through the Platform is protected by the Platform's confidentiality and security measures as described in the Terms of Service, but attorney-client privilege does not attach until an attorney-client relationship is created through your acceptance of an Engagement Letter.

4.2 Data Security

  • All data is encrypted in transit and at rest
  • Access is restricted to your assigned attorney and authorized platform personnel
  • We maintain audit logs of all access to your information
  • We do not sell or share your information with third parties. Information sharing is limited to what is described in this Disclosure, the Terms of Service, and the Privacy Policy.

4.3 AI Processing and Data Security

Enzio.ai currently uses a third-party AI service (such as Anthropic's Claude) to assist with document preparation, client profile generation, and matter analysis. By consenting to AI-assisted services, you acknowledge and agree that your information will be transmitted to this third-party AI service for processing.

Third-Party AI Processing: Anthropic is contractually prohibited from using your information to train its AI models, and Anthropic's API terms provide that inputs and outputs are not used for model training. Enzio.ai has selected a provider whose data handling practices are consistent with the confidentiality obligations described in this Disclosure.

No Unauthorized Retention: The third-party AI service processes your information in real time to generate outputs for attorney review. Your information is not retained by the third-party AI service beyond what is necessary to process your request, subject to the third-party provider's data retention policies.

Proprietary AI Development: Your anonymized information may be used to improve Enzio.ai's proprietary AI systems, subject to strict de-identification protocols that remove all personally identifiable information before any such use. You may opt out of proprietary AI training use at any time by contacting privacy@enzio.ai. Opting out of training does not affect your ability to use the Platform or the quality of services you receive.

Changes to AI Providers: Enzio.ai may change or add AI service providers in the future. If we make a material change to our AI processing infrastructure, we will update this Disclosure and notify you before the change takes effect. Your continued use of the Platform after such notification constitutes acceptance of the updated Disclosure.

5. BENEFITS OF AI ASSISTANCE

AI tools enable us to provide:

  • Faster turnaround times
  • More affordable fixed-fee pricing
  • Consistent document quality
  • Comprehensive error checking
  • 24/7 availability for intake and status updates

6. LIMITATIONS OF AI

AI tools have limitations:

  • AI may generate incorrect or incomplete information.
  • AI cannot understand nuanced or unusual situations without attorney guidance.
  • AI cannot replace the need for attorney judgment on complex matters.
  • AI performance depends on the quality of input information.
  • AI outputs may reflect the limitations of the third-party AI service used to generate them, including potential inaccuracies in legal analysis or jurisdiction-specific requirements.

Your attorney reviews all AI output specifically to identify and correct these limitations.

You may opt out of having your anonymized information used to improve Enzio.ai's proprietary AI systems by contacting privacy@enzio.ai at any time. Opting out does not affect your ability to use the Platform or the quality of services you receive. This opt-out right applies to Enzio.ai's proprietary AI training only and does not affect the processing of your information by the third-party AI service as described in Section 4.3, which is required to provide AI-assisted services on the Platform.
